RAFFLE DRAW TERMS AND CONDITIONS
Background
(A) The Autofest International Ltd. is conducting a promotional raffle draw (the "Raffle")
for the purpose of promoting Autofest x Trade Expo Event in accordance with the
applicable laws and regulations of the Federal Republic of Nigeria.
(B) The Raffle is designed to promote the event and shall be conducted in a fair,
transparent, and lawful manner consistent with Nigerian consumer protection laws
and regulations governing promotional activities.
(C) These Terms and Conditions establish the comprehensive framework governing the
conduct of the Raffle, including but not limited to entry procedures, eligibility
requirements, prize distribution, winner selection process, and the rights and
obligations of all parties involved.
(D) The Autofest International Ltd. has obtained or will obtain all necessary permits,
licenses, and regulatory approvals required under Nigerian law for the conduct of this
Raffle, including compliance with relevant consumer protection regulations and tax
obligations.
(E) Participation in the Raffle is voluntary and constitutes acceptance of these Terms and
Conditions by each participant, creating a binding legal relationship between the
participant and the Autofest International Ltd..
(F) The Raffle shall be conducted over the period from October 2nd 2025 to November
22nd 2025, with the draw taking place on November 22nd 2025 at Ilorin Metropolitan
Square Asa Dam.
1. Eligibility Requirements
1.1. Age Requirement: Participation in the Raffle is restricted to individuals who have
attained the age of eighteen (18) years or above at the time of entry.
1.2. Residency Requirement: Only individuals who are legal residents of the Federal
Republic of Nigeria and possess valid identification documents issued by Nigerian
authorities are eligible to participate.
1.3. Legal Capacity: Participants must have full legal capacity to enter into binding
agreements under Nigerian law and must not be subject to any legal disability or
incapacity.
1.4. Single Entry per Person: Each eligible person is permitted only one (1) entry per
entry method specified in these Terms and Conditions, unless otherwise expressly
stated.
1.5. Employee Exclusions: The following persons are not eligible to participate in the
Raffle:
(a) Employees, directors, officers, and consultants of the Organizer and their
immediate family members.
(b) Employees of any advertising, promotional, or marketing agencies engaged
by the Organizer in connection with the Raffle.
(c) Any person involved in the design, production, or administration of the
Raffle.
1.6. Compliance with Laws: Participants must not be prohibited from participating in
promotional activities under any applicable Nigerian law or regulation.
1.7. Verification of Eligibility: The Organizer reserves the right to verify the eligibility
of any participant at any time and may require proof of age, residency, and identity
before awarding any Prize.
1.8. Disqualification for Ineligibility: Any entry submitted by an ineligible person shall
be void, and such person shall be disqualified from the Raffle without notice.
2. Entry Methods and Procedures
2.1. Entry Methods: Participants may enter the Raffle through the authorized methods
only which is buy paying for the raffle ticket on the website.
2.2. Entry Requirements: Each Entry must include all of the following information and
comply with the specified requirements:
(a) Participant's full legal name as it appears on official identification;
(b) Valid contact information including telephone number and email address;
(c) Proof of eligibility as specified in Section 2 of these Terms and Conditions;
(d) Any additional information or materials specifically required for the
particular entry method chosen.
2.3. Entry Limits: Each Eligible Participant is limited to a maximum of Three (3)
Entries during the entire Entry Period, regardless of the entry method(s) used.
2.4. Entry Validation: The Organizer reserves the right to verify the authenticity and
validity of any Entry and may reject any Entry that does not comply with these
Terms and Conditions.
2.5. Entry Acknowledgment: Receipt of Entries will be acknowledged in the manner
specified for each entry method, but such acknowledgment does not guarantee that
the Entry is valid or has been accepted for the Raffle.
2.6. Technical Requirements: Participants are responsible for ensuring they have the
necessary technology, internet connection, and technical capabilities to submit their
Entry successfully.
3. Entry Period
3.1. The Entry Period for the Raffle shall commence on October 2nd 2025 at 8 am
Nigerian time and shall conclude on November 22nd 2025 at 7pm Nigerian time.
3.2. Only entries received during the Entry Period shall be eligible for consideration in
the Raffle draw.
3.3. Entries submitted before the commencement of the Entry Period or after the
conclusion of the Entry Period shall be automatically disqualified and shall not be
considered for the draw.
3.4. The Organizer reserves the right to extend the Entry Period by providing forty-eight
(48) hours advance notice to participants through the same channels used to
promote the Raffle.
3.5. In the event of technical difficulties or unforeseen circumstances that prevent
participants from submitting entries, the Organizer may, at its sole discretion, extend
the Entry Period for a reasonable duration not exceeding seven (7) days.
3.6. Any extension of the Entry Period shall be communicated to participants through
official channels and shall automatically adjust the Draw Date accordingly to allow
for proper processing of entries.
3.7. Time references in these Terms and Conditions shall be based on Nigerian Standard
Time, and participants are responsible for ensuring their entries are submitted within
the specified timeframe regardless of their geographical location.
4. Prize Description
4.1. The Raffle offers the following prizes to be awarded to selected Winners in
accordance with these Terms and Conditions:
(a) LEXUS IS250 (1 UNIT)
(b) MOTORCYCLE (1 UNIT)
(c) TRICYCLE (1 UNIT)
4.2. All prize values stated are estimates based on recommended retail prices at the time
of publication of these Terms and Conditions and are subject to market fluctuations.
4.3. Prizes are awarded strictly as described and no cash alternative, substitution, or
transfer of prizes is permitted except at the sole discretion of the Organizer.
4.4. Where a prize consists of goods or services, the Winner accepts the prize subject to
the manufacturer's or service provider's standard terms and conditions of sale or
supply.
4.5. The Organizer reserves the right to substitute any prize with an alternative prize of
equal or greater value without prior notice if the original prize becomes unavailable
due to circumstances beyond the Organizer's reasonable control.
4.6. Winners are responsible for all costs and expenses associated with accepting,
collecting, or utilizing their prize that are not expressly included in the prize
description.
4.7. All prizes must be collected within the Prize Collection Period specified in these
Terms and Conditions, failing which the prize shall be forfeited without
compensation.
4.8. Prizes are non-transferable and may not be sold, exchanged, or assigned to third
parties without the express written consent of the Organizer.
5. Draw Process
5.1. The Draw shall be conducted at Ilorin Metrorpolitan Square Asa Dam or through an
approved electronic random selection system.
5.2. Winners shall be selected through a random draw process using either:
(a) A mechanical drawing system where all Eligible Entries are placed in a
sealed container and drawn randomly by an independent third party; or
(b) A computer-generated random selection system that has been certified as
fair and unbiased by a qualified independent auditor.
5.3. The Organizer shall maintain complete records of the Draw process, including:
(a) A list of all Eligible Entries included in the Draw;
(b) The method used for winner selection;
(c) The identity of all witnesses present during the Draw;
(d) Video or photographic documentation of the Draw process where
technically feasible.
5.4. If a selected entry is determined to be ineligible after the Draw, the Organizer shall
conduct a supplementary draw to select an alternative winner using the same process
outlined in this section.
5.5. The results of the Draw shall be final and binding, subject only to verification of
winner eligibility and compliance with these Terms and Conditions.
5.6. The Organizer shall make the Draw records available for inspection by relevant
regulatory authorities upon request and may publish general Draw statistics for
transparency purposes while maintaining winner privacy.
6. Winner Selection and Notification
6.1. The Draw shall be conducted on the Draw Date using a random selection method
that ensures equal opportunity for all Eligible Entries to be selected as winning
entries.
6.2. The Organizer shall select winners in the order of first prize, second prize, and
subsequent prizes as applicable, with each selected entry being removed from
subsequent draws to prevent duplicate wins by the same Participant.
6.3. The Organizer shall verify the validity of each selected entry and the eligibility of
the corresponding Participant before confirming such Participant as a Winner.
6.4. Winner Notification shall commence within seventy-two (72) hours following the
completion of the Draw and verification process.
6.5. The Organizer shall attempt to contact each Winner using the contact information
provided during entry submission, including but not limited to telephone, email, or
registered mail as deemed appropriate by the Organizer.
6.6. Each Winner must respond to the Winner Notification within seven (7) days of the
initial contact attempt, failing which the Organizer may, at its sole discretion,
disqualify such Winner and select an alternative winner.
6.7. Upon initial contact, Winners shall be required to provide proof of identity and
eligibility, including but not limited to valid government-issued identification and
evidence of compliance with the eligibility requirements set forth in Section 2.
6.8. The Organizer reserves the right to conduct additional verification procedures,
including but not limited to requesting statutory declarations or affidavits confirming
the Winner's eligibility and compliance with these Terms and Conditions.
6.9. Winners who fail to provide satisfactory verification documentation within the
timeframe specified by the Organizer shall be disqualified, and alternative winners
may be selected at the Organizer's discretion.
6.10. The Organizer shall maintain records of all Winner selection and notification
activities in accordance with applicable Nigerian record-keeping requirements.
7. Prize Collection and Delivery
7.1. Prize Claim Period: Winners must claim their Prize(s) within thirty (30) days from
the date of Winner Notification, failing which the Prize shall be forfeited and may be
awarded to an alternate winner at the Organizer's sole discretion.
7.2. Verification Requirements: Prior to Prize collection, Winners must provide valid
identification and complete any verification forms required by the Organizer,
including but not limited to proof of identity, age, and eligibility status.
7.3. Prize Collection Methods: Prizes may be collected through the following methods
as determined by the Organizer:
(a) Personal collection at the Organizer's designated location during business
hours;
(b) Delivery to the Winner's verified address within Nigeria; or
(c) Such other method as may be specified by the Organizer in the Winner
Notification.
7.4. Delivery Arrangements: Where Prize delivery is arranged by the Organizer:
(a) The Organizer shall use reasonable efforts to deliver the Prize to the
Winner's verified address;
(b) The Winner shall be responsible for providing accurate delivery
information and ensuring availability to receive the Prize;
(c) The Organizer shall not be liable for failed delivery attempts due to
incorrect information provided by the Winner or the Winner's unavailability.
7.5. Transfer Restrictions: Prizes are personal to the Winner and may not be transferred,
assigned, or substituted except at the Organizer's sole discretion.
7.6. Prize Substitution: The Organizer reserves the right to substitute any Prize with
another prize of equal or greater value if the original Prize becomes unavailable for
any reason.
7.7. Collection Costs: Unless otherwise specified, Winners shall be responsible for any
costs associated with Prize collection, including but not limited to transportation
costs to collection points.
7.8. Receipt and Acknowledgment: Winners must sign appropriate receipts and
releases upon Prize collection as may be required by the Organizer.
8. Taxes and Fees
8.1. Winner Tax Responsibility: Each Winner shall be solely responsible for all
applicable taxes, duties, levies, and charges imposed by any governmental authority
in Nigeria or elsewhere in connection with the receipt, acceptance, or use of any
Prize.
8.2. Tax Withholding: The Organizer reserves the right to withhold any taxes required
by law from Prize values and shall provide Winners with appropriate tax
documentation as required under Nigerian tax legislation.
8.3. Prize Value Declaration: Winners acknowledge that Prizes may be subject to
taxation based on their fair market value as determined by the Organizer in
accordance with applicable Nigerian tax regulations.
8.4. Collection Costs: Any costs associated with Prize collection, delivery, or transfer,
including but not limited to transportation, insurance, storage, or handling fees, shall
be borne by the Winner unless otherwise specified in these Terms and Conditions.
8.5. Third Party Fees: Winners shall be responsible for any fees, charges, or costs
imposed by third parties in connection with Prize redemption, including but not
limited to banking fees, conversion charges, or service fees.
8.6. Tax Compliance: Winners are advised to consult with qualified tax professionals
regarding their tax obligations and shall comply with all applicable tax reporting and
payment requirements under Nigerian law.
8.7. Organizer Limitation: The Organizer's obligation is limited to delivering the Prize
as described, and the Organizer shall not be liable for any tax consequences,
penalties, or additional costs incurred by Winners.
9. Disqualification Conditions
9.1. A Participant shall be automatically disqualified from the Raffle and forfeit any right
to prizes if they fail to meet the eligibility requirements set out in Section 2 of these
Terms and Conditions at any time during the Entry Period or thereafter.
9.2. The Organizer may disqualify any Participant who:
(a) submits false, incomplete, or misleading information in their Entry;
(b) attempts to enter the Raffle through fraudulent means or misrepresentation;
(c) violates any provision of these Terms and Conditions;
(d) engages in conduct that the Organizer reasonably determines to be abusive,
harassing, or disruptive to other Participants or the Raffle process;
(e) attempts to tamper with, manipulate, or interfere with the proper conduct of
the Raffle or the Draw process;
(f) submits multiple Entries where prohibited under Section 3 of these Terms
and Conditions.
9.3. A Winner shall be disqualified and forfeit their Prize if they:
(a) fail to respond to Winner Notification within the timeframe specified in
Section 7;
(b) cannot be contacted using the information provided in their Entry;
(c) fail to provide satisfactory proof of identity or eligibility when requested;
(d) fail to collect their Prize within the Prize Collection Period specified in
Section 8;
(e) are found to have violated any provision of these Terms and Conditions
after being selected as a Winner.
9.4. The Organizer reserves the right to investigate any suspected violation of these
Terms and Conditions and may require additional documentation or information
from any Participant to verify compliance.
9.5. Disqualification decisions made by the Organizer shall be final and binding, and no
correspondence shall be entered into regarding such decisions.
9.6. Upon disqualification of a Winner, the Organizer may, at its sole discretion, select
an alternative Winner through the same Draw process or declare the relevant Prize
void.
9.7. Disqualified Participants forfeit all rights to any prizes and shall not be entitled to
compensation or alternative consideration from the Organizer.
10. Limitation of Liability
10.1. The Organizer's total liability to any Participant in connection with this Raffle,
whether arising in contract, tort, negligence, or otherwise, shall not exceed the value
of the Prize won by such Participant.
10.2. The Organizer shall not be liable for any indirect, incidental, consequential, special,
or punitive damages, including but not limited to loss of profits, loss of data, loss of
business opportunities, or personal injury, arising from or in connection with
participation in the Raffle.
10.3. The Organizer makes no warranties or representations, express or implied, regarding
the Prizes, including but not limited to warranties of merchantability, fitness for a
particular purpose, or non-infringement.
10.4. The Organizer shall not be liable for any failure to perform its obligations under
these Terms and Conditions due to circumstances beyond its reasonable control,
including but not limited to acts of God, natural disasters, government actions, civil
unrest, technical failures, or internet connectivity issues.
10.5. Participants acknowledge that they enter the Raffle at their own risk and that the
Organizer shall not be responsible for any costs, expenses, or damages incurred by
Participants in connection with their participation.
10.6. The Organizer shall not be liable for any errors, omissions, interruptions, deletions,
defects, delays in operation or transmission, communications line failures, or
technical malfunctions that may affect the conduct of the Raffle.
10.7. Any Prize that is damaged, lost, stolen, or becomes unavailable after Winner
selection but before collection shall be provided on an "as is" basis, and the
Organizer's sole obligation shall be to use reasonable efforts to provide a substitute
Prize of equivalent value.
10.8. The limitations and exclusions of liability set forth in this Section 11 shall apply to
the maximum extent permitted by the Applicable Laws of Nigeria and shall survive
termination of these Terms and Conditions.
11. Data Protection and Privacy
11.1. Data Collection: The Organizer shall collect personal information from Participants
only to the extent necessary for the administration of the Raffle, including but not
limited to name, contact details, age verification information, and any other
information required to determine eligibility and facilitate prize distribution.
11.2. Lawful Basis for Processing: The Organizer processes Participant personal data
based on the legitimate interest of conducting the Raffle and fulfilling contractual
obligations arising from these Terms and Conditions, in compliance with the Nigeria
Data Protection Regulation 2019.
11.3. Data Use Limitations: Personal information collected shall be used solely for the
purposes of:
(a) Verifying Participant eligibility and compliance with these Terms and
Conditions;
(b) Conducting the Draw and selecting Winners;
(c) Notifying Winners and facilitating prize collection;
(d) Complying with applicable legal and regulatory requirements;
(e) Responding to queries and disputes related to the Raffle.
11.4. Data Security: The Organizer shall implement appropriate technical and
organizational measures to protect Participant personal data against unauthorized
access, disclosure, alteration, or destruction, in accordance with applicable Nigerian
data protection laws.
11.5. Data Retention: Personal information shall be retained only for the period
necessary to fulfill the purposes for which it was collected, and in any event shall be
deleted or anonymized within twelve (12) months following the conclusion of the
Prize Collection Period, unless longer retention is required by applicable law.
11.6. Third Party Disclosure: The Organizer shall not disclose Participant personal
information to third partiess except:(a) Where necessary for prize fulfillment and delivery;
(b) As required by applicable law or court order;
(c) With the express written consent of the Participant.
11.7. Participant Rights: Participants have the right to request access to, correction of, or
deletion of their personal data held by the Organizer, subject to the Organizer's
legitimate interests in conducting the Raffle and complying with legal obligations.
11.8. Cross-Border Transfers: Where personal data is transferred outside Nigeria, the
Organizer shall ensure adequate protection measures are in place in compliance with
applicable data protection regulations.
11.9. Privacy Queries: Participants may direct privacy-related queries or requests to the
Organizer using the contact information specified in these Terms and Conditions.
12. Modification of Terms
12.1. The Organizer reserves the right to modify, amend, or supplement these Terms and
Conditions at any time during the Entry Period, provided that such modifications do
not materially prejudice the rights of Participants who have already submitted
Eligible Entries.
12.2. Any modifications to these Terms and Conditions shall be effective immediately
upon publication through the same channels used to originally communicate these
terms to Participants.
12.3. The Organizer shall provide notice of material modifications by:
(a) Publishing the updated Terms and Conditions on the official Raffle website
or platform;
(b) Sending notification through the primary communication channel used for
the Raffle; and
(c) Clearly indicating the date of modification and the specific changes made.
12.4. Participants who continue to participate in the Raffle after notification of
modifications shall be deemed to have accepted the revised Terms and Conditions.
12.5. If any modification is deemed to materially and adversely affect Participants' rights,
existing Participants may withdraw from the Raffle and request removal of their
entries within seven (7) days of the modification notice.
12.6. No modifications shall be made within forty-eight (48) hours of the Draw Date
unless required by Applicable Laws or court order.
12.7. The Organizer's failure to exercise the right to modify these Terms and Conditions
shall not constitute a waiver of such right.
13. Termination Rights
13.1. Termination by Organizer: The Organizer reserves the right to cancel, suspend, or
terminate the Raffle at any time before the Draw Date for any reason, including but
not limited to circumstances beyond the Organizer's reasonable control.
13.2. Force Majeure Events: The Raffle may be terminated immediately upon the
occurrence of force majeure events.
